DRIVING WITHOUT A LICENSE

You probably already know that driving without a current and valid license in Colorado is against the law. But what you may not be aware of is the extent of the penalties, as outlined in under C.R.S. 42-2-101.

If you simply forgot to take your license with you while driving -- or if you license has been expired for one year or less -- then driving without a license in Colorado is only a class B traffic infraction. The penalty is a fine of $15 to $100.

But if you do not have a license at all – or if your prior license has been expired for more than one year – then driving without a license is a class 2 misdemeanor traffic offense. The sentence carries 10 to 90 days in county jail, and/or $150 to $300 in fines.

A conviction of driving without a license can also prevent the defendant from getting a Colorado driver's license for one year.

Note that driving without a license is a completely separate offense from driving on a revoked or suspended license. Those penalties can be much harsher, especially if the reason for the suspension was a DUI.
