'I wasn't infringing your trade mark. It was mine!' Karlsson v Griffith

'I wasn't infringing your trade mark. It was mine!' Karlsson v Griffith We have the owner of a trade mark which is a slogan. Over time, the owner stops using the slogan.

Another party asks to become the new owner. The former owner agrees meaning the other party becomes the new owner.

Then the new owner sues the former owner for trade mark infringement!
